The front is sufficient.</p><p>3. The rental agreement showing the names, legal addresses and signatures of ALL tenants and landlords.</p><p>4. Your tenant should then provide this to ING with the other documents.</li></ul><p>Have the original signatories been replaced in the meantime?</p><ul><li>Then also submit supporting documents (e.g. a copy of the deed of appointment), as well as a copy of the identity card of the new representatives.</li></ul>"}},{"title":"The tenant is deceased","richBody":{"value":"<p><strong>I am an heir of the tenant:</strong></p><p>If the tenant is deceased, the heirs must go to an ING branch for the release of the rental guarantee.</p><p><strong>1. The heirs do NOT want to continue living in the property:</strong></p><ul><li>The heirs and the landlord(s) must agree to stop the rental agreement and release the rental guarantee.</li><li>Heirs must go to the branch to stop the rental agreement, close the account and release the rental guarantee.</li><li>Heirs must present a certificate of succession in the branch.</li></ul><p><strong>2. Heirs would like to continue living in the property:</strong></p><ul><li>Heirs must go to the office to adjust the rental guarantee or prepare a new rental guarantee, with the landlord&apos;s consent.</li><li>The heirs can continue to live in the home under the same conditions.</li><li>They pay the rent and maintain the property.</li></ul><p> </p><p><strong>I am a landlord:</strong></p><p>What should the landlord do if there are <strong>no heirs</strong> or if they refuse the inheritance?</p><ul><li>The landlord can go to court to release the rental guarantee.</li><li>The landlord can request the deed of repudiation of the inheritance from the heirs and provide it to ING.</li></ul>"}},{"title":"The landlord is deceased","richBody":{"value":"<p><strong>I am a tenant:</strong></p><p>First, re-read your rental agreement to understand what happens if the landlord dies.</p><p><strong>1. Tenants want to continue living in the property:</strong></p><ul><li>Contact the heirs or appointed administrator for new payment instructions.</li><li>It is the responsibility of the heirs or appointed administrator to notify ING of the death.</li></ul><p><strong>2. Tenants wish to move out</strong></p><ul><li>If tenants wish to terminate the rental agreement, they must inform all heirs and then they can request closure via email.</li><li>The tenant must have the release form signed by all heirs of the deceased landlord with “full ownership” or “usufruct&quot;.<br /> </li></ul><p><strong>I am an heir of the landlord:</strong></p><p>What should the heirs (or the appointed administrator) of the deceased landlord do if there is a rental guarantee in his/her name with ING?</p><ul><li>The heirs take over the rights and obligations of the deceased landlord.</li><li>If the contract does not state that the lease ends in case of death, it remains valid.</li><li>Contact tenants quickly with new payment instructions.</li><li>Consider appointing an agent for any problems.</li><li>Provide ING with the following documents:<ul><li><strong>Transfer deed </strong>from the notary.</li><li>OR a <strong>copy of the power of attorney</strong>, if there is a trustee.</li></ul></li></ul>"}},{"title":"There is a court decision regarding the rental guarantee","richBody":{"value":"<p>If there is a dispute regarding damages, unpaid rent, breach of contract, unclear rental agreements, fraud, deception,... and no mutual agreement has been reached, <strong>a court decision</strong> is necessary to release the rental guarantee.</p><p>The winning party must then provide ING with the following documents:</p><ul><li><strong>The court decision + The release form,</strong> only signed by the winning party<br /><br />OR</li><li><strong>The court decision + A letter from the winning party&apos;s lawyer</strong></li></ul>"}},{"title":"The owner of the property changes during the rental agreement","richBody":{"value":"<p><strong>What should I do as a tenant?</strong></p><ul><li>As a tenant, you must do nothing; the landlord must take care of everything.<br /> </li></ul><p><strong>What should I do as a landlord?</strong></p><ul><li>If there is a new owner during the lease, the new owner must provide ING with the transfer deed<ul><li>This can be a <strong>full deed of sale</strong> OR a<strong> notarial statement </strong>indicating that the rental guarantee has been transferred.</li></ul></li></ul>"}},{"title":"Tenant has a legal administrator","richBody":{"value":"<p>If the tenant has an administrator, the administrator can sign the release document on behalf of the tenant.<br />Is the rental guarantee being transferred to a blocked account at another bank?</p><ul><li>If so, send the <strong>proof that this account is blocked</strong> along to ING.</li></ul><p>Is administrator not yet registered with ING or does the tenant have a new administrator?</p><ul><li>In that case, also send <strong>the proof of the administrator</strong>, along with the other documents, to ING.</li></ul>"}}]},{"componentType":"sectionTitle","title":"I am a landlord and want to close the rental guarantee"},{"componentType":"paragraph","richBody":{"value":"<p>Does your tenant have a rental guarantee at ING? Then it is the tenant&apos;s responsibility to close it.</p><p><strong>As a landlord, you can take the following steps in the meantime:</strong></p><ol><li>Remind your tenant that the end of the contract is approaching.</li><li>If necessary, appoint an expert for an evaluation of the property.</li><li>Are you an ING customer (private or self-employed), the only landlord and there is only one tenant as well? Then ask your tenant to initiate the online release.</li><li>In other cases, ask your tenant to fill out the release form and send it to you.
